Statement from MJ Estate:

You will soon be reading news reports stating that Colony Capital has decided to sell Neverland. As the property manager, they have the right to do this. The Estate has issued the following statement in response to a media request for comment:

We are saddened at the prospect of the sale of Neverland which, under the agreement negotiated during Michael's lifetime, Colony has the right to sell. The Estate will maintain Michael's family home in Encino, including its iconic recording studio there. We continue to build upon Michael's legacy as an artistic genius and humanitarian through his music and new projects such as the Michael Jackson ONE show in Las Vegas. We hope and trust that any new owners of Neverland will respect the historical importance and special nature of this wonderful property. Michael's memory lives on in the hearts of his fans worldwide.

It is also important to the Estate that Michael's fans understand that although the Estate has no right to stop or obstruct the sale, The Estate did explore a number of potential options for Neverland with Colony but zoning, financial and land use restrictions limited the alternatives and ultimately Colony made the decision to sell.

As you might know Robson has two cases against MJ Estate, one of them is a creditor’s claim filed at probate court and second one is a civil case. Below includes updates and information about both cases.

Probate case:  Robson is asking to be allowed to file a late creditor claim (9103 motion). Estate opposed to it. Summary judgment motion is pending. Estate says if late filing of creditor claim is granted, they would likely deny the creditor’s claim and Robson said if that’s the case he would add Executors as Doe 4 and Doe 5 in his civil trial. It’s stated that the 9103 petition will be tried in court in February 2015.

Civil case: Estate has filed two demurrers (dismissal request stating there’s no legal basis for a lawsuit); both are pending with a hearing set for October 2014. Executors may file additional demurrers.

There is a scheduling issue in regards to the trial. Robson proposed the trial to start at June 2015. Estate objects to it and states it’s too early to set a trial date based on the following:

  • Probate late filing petition (9103) isn’t being tried until February 2015. Assuming late filing of creditor’s claim is denied (either by court or Estate) and Estate is added to the civil trial between February and June (2015) they won’t have enough time to respond to complaint, file demurrer, file motions, take discovery, respond to discovery and find experts.
  • Estate is also opposing to possibly dividing the case and trying defendants separately.

Robson has served several hundred interrogatories (over the limit of 35) and these requests are subject to protective order. Estate states most interrogatories are about MJ’s alleged personal and private conduct and they have no information. Robson lawyers refuse Estate’s request to meet and confer about interrogatories.

Parties :

Noval Williams Films / Craig Williams – Plaintiff.

MJ Estate - Defendant.

Third party who shot the footage – never identified but MJ Estate believes it to be Green Flame Media.

Lightning Entertainment - who has a sales agency agreement with Noval Williams Films

Summary

- In 2007 MJ took part in two photo shoots.  Noval Williams Films claims MJ authorized a third party to videotape both photo shoots and the third party is the copyright owner.  Part of the footage has been released publicly or commercially in November 2007.

- In July 2011, a lawyer representing the third party who shot the footage contacted Karen Langford from MJ Estate to sell the footage to MJ Estate.  They showed portions of it to MJ Estate. They asked $250,000 to buy it, additional $250,000 for limited commercial usage (less than 10 minutes) and additional $750,000 to have full rights (so a total of $1.25 Million).  Estate did not purchase it.

Original TMZ Story

One irate Michael Jackson fan is suing his Estate because she thinks MJ was not the lead singer on 3 of his songs on the 2010 CD '"Michael"... the first release after his death.

The woman filed the suit today in L.A. claiming she bought the disc in 2011, but didn't hear enough Michael on 3 particular tracks.

In the suit she claims she hired an audio expert to analyze her CD and he determined it was very likely that MJ did not sing lead vocals on "Breaking News", "Monster", "Keep Your Head Up."

The woman wants this to be a class action -- meaning if the allegation is true the Estate would owe money to everyone who bought the full album, or any of the 3 tracks in question.

The Estate's lawyer, Howard Weitzman, has previously said Michael did provide lead vocals for all the tracks on the album.

Update: From The Wrap

Sony had no comment for TheWrap. However, Howard Weitzman, attorney for the Michael Jackson estate, vehemently denied the allegations when contacted by TheWrap, saying that the vocal tracks had been authenticated by multiple experts.
 
“This lawsuit filed 3 ½ years after the album's release we consider to be frivolous. The Estate believes the lead vocals on all tracks of the ‘Michael’ album were sung by Michael Jackson,” Weitzman said in a statement. “Two musicologists and 6 former producers of Michael's prior albums confirmed that it was Michael Jackson's voice on lead vocal.”
