November 2012

Michael Jackson's personal assistant has filed a class action lawsuit against AEG, claiming he and the rest of the employees connected with the "This Is It" tour lost lots of money because the company negligently hired and supervised Dr. Conrad Murray.

Williams is asking for unspecified damages.

It's a breach of contract lawsuit. Here's the document : http://www.scribd.com/doc/113142039/Michael-Amir-Complaint

-------------------------------------------------

AEG’s lawyer, Marvin Putnam of O’Melveny & Myers, calls the lawsuit "frivolous" and "truly unfortunate."

"This lawsuit is clearly frivolous; it is literally barred by at least four different legal doctrines," Putnam said in a statement provided to TheWrap. "The easiest is that Mr. Williams was a personal employee of Michael Jackson’s, and was never a beneficiary of Mr. Jackson’s contract with AEG Live. As such he has no legal standing to sue on that contract. Nor can he legally bring a claim for Mr. Jackson’s wrongful death. The idea that Mr. Williams purports to sue on behalf of the many persons who did enter into relationships with AEG Live and Jackson in connection with the This Is It Tour, and with whom AEG Live parted ways with the utmost friendship and respect, is disgraceful. It is truly unfortunate that so many see Mr. Jackson’s demise as an opportunity to grab as much for themselves as possible. This is just the latest wrongful death lawsuit with someone hoping to profit from Michael Jackson’s tragic death in the same way they profited from his life."

December 2012

Documents aren't available but AEG has filed a demurrer - which is a dismissal request saying that there's no legal basis for such lawsuit. Oral arguments hearing are set for January 22.

Hearing on Demurrer

----------------------------------

In laymans terms MAW edited his first complaint to add MJ Estate as a defendant. The court has twice sustained the demurrer - which means the court granted AEG and /or Estate's request to dismiss parts or all of the lawsuit. "with leave" means that MAW still has the option to edit the complaint and resubmit it.

Filed by Attorney for Defendant/Respondent

11/04/2013 Request for Dismissal (OF CLASS ACTION )
Filed by Attorney for Plaintiff/Petitioner

---------------------------------------------

It looks like there's something wrong with MAW's claims so he's looking to dismiss this case to file another one (without prejudice) but AEG lawyers are opposing this and want the judge to dismiss the case with prejudice so it can't be filed again.

December 2013

Let's do some updates- just based on case summary.

There have been 3 amended complaints in this lawsuit and it looks like at one point MJ Company (managed by Estate) was added to the lawsuit as a defendant.

10/21/2013 at 01:30 pm in Department 323, ELIHU M. BERLE, Presiding Hearing on Demurrer - Demurrer sustained with leave

On October 21 Judge granted the dismissal request by AEG & MJ Company based on no legal basis. "With leave" allowed MAW to edit and file another complaint.

11/04/2013 Request for Dismissal (OF CLASS ACTION ) Filed by Attorney for Plaintiff/Petitioner

Then MAW lawyer filed a dismissal of class action

AEG and MJ Company followed with these

11/22/2013 Notice of Motion (M/ENTRY OF JUDGMENT 12-17 WEITZMAN )
Filed by Attorney for Defendant/Respondent

11/05/2013 Motion (FOR ENTRY OF JUDGMENT WITH PREJUDEICE; OPPOSITION TO BELATED REQUEST FOR DISMISSAL OF CLASS ACTION (WITHOUT PREJUDICE); MEMO- RANDUM OF POINTS AND AUTHORITIES IN SUPPORT THEREOF)
Filed by Attorney for Defendant/Respondent

11/05/2013 Declaration (OF BRIAN FINKELSTEIN IN SUPPORT OF DEFENDANT'S MOTION FOR ENTRY OF JUDGMENT WITH PREJUDICE; OPPOSITION TO PLAINTIFF'S BELATED REQUEST FOR DISMISSAL OF CLASS ASTION (WITHOUT PREJUDICE))
Filed by Attorney for Defendant/Respondent

These makes us understand that MAW wanted to dismiss the class action but be able file the lawsuit again (without prejudice) however AEG and MJ Company wanted it to be dismissed "with prejudice" asking the court to dismiss it once and for all and it could not be brought back to court.

12/17/2013 at 11:00 am in Department 323, ELIHU M. BERLE, Presiding Hearing on Demurrer (2) MOTION TO DISMISS WITHPREJUDICE) -Granted

Based on this last information, I'm thinking (remember this is just my reading of the information and I might be wrong) MAW's lawsuit is dismissed for good. Unfortunately no documents are available online to read and confirm

March 2014

MAW ordered to pay costs to MJ Estate and AEG

02/06/2014 Memorandum of Costs ($4365.00 awarded to Defendant The Michael Jackson Co. LLC entered on judgment of 1-8-14 on 3-4-14 )
Filed by Attorney for Defendant/Respondent

01/23/2014 Memorandum of Costs ($4471.00 awarded to counsel for Defendant AEG LIce, LLC; Anschutz Ent. Group entered on judgment dated 1-8-14 on 3-4-14 )
Filed by Attorney for Defendant/Respondent

With this we'll classify this lawsuit as dismissed and over.
